What Is An Electronic Signature?
There are three types of electronic signatures, with different levels of security:
- Simple Electronic Signatures: These are basic electronic signatures and digital representations of one’s handwritten signature. They have a low level of security and can be as simple as drawing your signature on a Terms & Conditions document.
- Advanced Electronic Signatures: They are more secure and often include advanced cryptographic algorithms to help verify the signer's authenticity. They offer a medium level of security and use unique data (cryptographic key) that is linked solely to the signer.
- Qualified Electronic Signatures: These have the highest level of security and are the only ones that can be considered equivalent to a handwritten signature. It involves a robust authentication method, such as using government-issued identification.
Who Can Sign Electronically?
Everyone – every person or entity can own a digital certificate and can sign electronic documents. The legal recognition of electronic signatures may vary depending on specific regulations or standards and the type of electronic signature used.
- Individuals: Individuals can sign electronic documents for contracts, agreements, forms, and so on. Any type of electronic signature can be used, including primary and simple electronic signatures.
- Businesses and Institutions: Companies, organizations, and government agencies all can use electronic signatures for contracts and other business-related or official documents.
Compared to handwritten signatures, electronic signatures can be used by authorized persons:
- In their own name;
- On behalf of another person or legal entity, with or without legal authority, under public or private law.
